Art. 10. Information given at the moment of data collecting
1. Data are collected:
a) to outline the customer's advertising target, in order to set out objective criteria to choose the information that will be sent to people interested, but also in order to produce aggregate statistical data;
b) supplying data is obligatory.
c) if data are not supplied, no service can be provided, as this is based on the data processing in order to select the information to present to the person interested;
f) Gauss srl, Via Marconi, 25 - 52037 Sansepolcro (AR) is holder of data processing, and MS Francesco Fabbri, legal representative, is responsible for data processing.
Art. 13. Rights of the person concerned
1. With regard to the use of personal data the person concerned has the right:
a) to learn, by free access to the register mentioned in art. 31, paragraph 1, letter a), the existence of data processing that may concern him;
b) of being informed of what mentioned in art. 7, paragraph 4, letters a), b), h);
c) to obtain, without any delay, by care of the holder or of the person responsible:
1) the confirmation of the existence or non-existence of personal data concerning him, although not yet logged, and the transmission in an intelligible form of the same data and of their origin, as well as the logic and the purposes of the data processing; the request can be made again after an interval of at least ninety days, unless justified reasons exist;
2) the deletion, the conversion into anonymous, or the arrest of the data processed with breach of the law, included those the preservation of which is not necessary for the purposes the data were collected or later processed for;
3) the updating, the rectification or, when interested, the integration of the data;
4) the declaration that operations at number 2) and 3) have been brought to the knowledge, also as for their content, of those to which data were transmitted or spread, except for the circumstance in which this accomplishment will be proved impossible or involving a use of means clearly out of proportion to the right defended;
d) to oppose entirely or partly, for legitimate reasons, to the use of personal data concerning him, though pertaining to the purpose of the collection;
e) to oppose entirely or partly to the use of personal data concerning him for commercial information or for the mailing of advertising material or for direct selling, as well as for doing market research or interactive commercial communication, and to be informed by the holder, not later than the moment in which his data are transmitted or spread, of the possibility to exercise this right freely.
2. For each request mentioned in paragraph 1, letter c), number 1), if the existence of personal data concerning him is not confirmed, the person concerned can be asked for a contribution to the expenses, that will not be higher than the costs incurred, according to the modes and the limits defined by the regulations mentioned in art. 33, paragraph 3.
3. The rights mentioned in paragraph 1, if referred to deceased people, can be exercised by whoever has an interest in doing it.
4. In the assertion of the rights mentioned in paragraph 1 the person concerned may sign a proxy statement or confer the proxy on individual persons or associations.
